Terms of Service

Below you can find my terms of service. To commission me you have to read and agree to it beforehand. Prices and examples can be found here. For specific questions send me an email <erro.kun93[at]gmail.com> and I will try to get back to you as soon as possible.
Please note that I only work with people that legally can give consent. I only work with people above the age of 18.

General information
The prices are base prices. They highly depend on complexity. For multiple arms or wings I will charge an extra fee. If you plan on commissioning me for sketches, illustrations and reference sheets, you need to have at least a coloured picture of your character, where I can pick the colours from easily. Please provide as much information as possible, during the sketching stage. I won’t edit work for free if you have forgotten to add details in the beginning, progressed beyond the rough draft.Complexity fee: from +10€ up to +40€Fee for changes after the piece is finished: 5€ -10€ for each edit. Only smaller things can be edited. The pose for example will never get redrawn at this stage.

What you will get1)You will get a high resolution, non watermarked picture.2) watermarked, smaller version, which you can upload to your galleries.Usually the high res. is around 5000 x 5000 px for full shaded artworks and 2500x2500 px for instream/sketch commissions. If you need exact size of the image, please note about it in commission description.

First steps
I am open for commissions most of the time, except when I announce a hiatus.If you contact me to talk about the commission, please make sure to give me every little bit of information about the character,personality, scene, pose, or anything else you deem important, as mentioned above. If you have a certain pose or concept in mind, please explain as precisely as possible or show references. That also counts for backgrounds. If you want a forest, make sure to tell me what should be depicted.
You also can give me the freedom of choosing a pose and fitting background for you, if you like. As for couple pictures, please explain their relationship briefly and tell me how they should react with each other.Please note that I do draw copyrighted characters only for personal, not for commercial use (such as prints). If you want someone else’s character in your picture, I need their written consent, that you are allowed to use them. If you want to share a commission with someone, I need you both to place a payment, or have written proof that one party pays for both. Refunds in this case will only be sent to the paying party, no matter of internal affairs.

Payment
Payment is only via paypal. 100% Prepayment, except upon agreement of a payment plan. The fee is included in my prices, the commissioner has no extra fees to carry. The prices are all in € (Euro). I currently do not accept other currencies, except stated otherwise. Paypal automatically converts currencies when payment is sent.In case of payment plan: the first part of the price has to be paid up front. Second and other parts are expected after the sketch is provided and the customer approves it. I won't start drawing until at least the first part of the payment is in my paypal account. If the commissioner wishes to pay the whole amount up front, that is doable. Payment plans are negotiable from prices of 150€ and above. You will get a full size commission without a watermark only after the full amount has been received.

Commercial use
If you would like to use one of my designs/adopts/redesigned characters/ artworks for commercial use, there will be an extra charge negotiated for it to transfer the commercial rights.

Progress
Once payment has been made and the details of the commission are discussed, I will start working. I work in order. 'Wips' (Work in progress pictures) will be sent to you once some progress can be shown.If there shouldn't be any progress within a week, feel free to send me a message and ask for progress. Usually I will send at least one to two 'Wips' a week, except when I announce that I have to take a few days off.I will edit and change the commission multiple times if the mistake lies with me. For edits after the work is completed I will charge an extra fee, look above. Deadline of commission depends on my queue and commission complexity, so it will be discussed individually. I will message you if any delays happen.I will correct mistakes from my side free of charge(for example: I forgot to draw the stripes, or left uncolored spots). I will not do continuous changes even at sketch stage. After the sketch is approved, I will only change small things at max. If the drawing is complete, I will not change things without a fee.

Cancelation & Refund
I may turn down a commission request with no reason given. If you not sure about your idea, check the "don't draw list" here. You can ask about whether your idea is okay, if you’re not sure if it fits into a category.If the case occurs that I really can’t finish a commission, I will pay you back in full. If you want to cancel the commission, you will get the rest of your payment, minus compensation for the work already completed. If the commission is halfway done, you will get 50% of the full amount and the unfinished piece of work. I always save the money until the transaction is completed, so I can always refund it when necessary. Please be open about that to avoid unnecessary conflict.

Image Rights and use of the finished artwork

✅ Repost your commission wherever you want except twitter, if you credit me as the artist.
✅ Crop the artwork and use it as icons, banners, etc.
✅ Print the artwork for your own use
✅ Print the artwork and gift it to friends
✅ Ask me to stay anonimus. No nicknames or any other information will be revealed in artwork’s watermark and description.
✅ Pay extra to keep commission private, or/and prevent me from selling/printing the artwork.
I'll charge 40% from the total price to not print/marchandise the art work
I'll charge 80% to keep art work totally private and not upload it anywhere.
✅ if you accidently lost your art file, I can send them to you again within 12 months of completion.
Commissioner can't
❌ Use the artwork for commercial purposes (e.g. selling prints), unless you purchased commercial rights
❌ Claim that you drew the artwork
❌ Create NFT from any of my artworks
❌ Feed my artworks to any kind of AI without my permission (Twitter now feeds all media to AI, so it's against my policy to post my art works there)
❌ Edit or alter the picture without my consent, respect the copyright law. If there is a change you want to make, please ask me about it and I might change it for free or charge a little fee, depending on the work.

Adoptables & Designs
References can be used as inspiration for design commissions. Though I do not make copies of existing characters, neither copyrighted, nor private. If you want a similar design to someone else's or someone's closed species, you need written permission to use that character/species as reference.I will transfer the rights of the design to the buyer, when a design is bought from me. The design is fully yours. Design can be edited, altered and used in every way possible except for making it a commercial. This does not contain the art itself, only the intellectual property for the design. The rights on the picture itself stay with me.You are allowed to resell adoptables for the same price you bought it for. I appreciate getting notified of sales.
